Very Amicable California Divorce....Need Advice and Insight


My wife and I have been married for 12 years, and we're very good friends. We have great kids, we like each other, enjoy spending time together, etc. The problem is that she's gay. We've tried every possible way to work with that for some time, but it's really just a total no-go. For many reasons related to that one inescapable fact, we simply cannot make this work any longer.


We are now discussing a very amicable divorce. Our plan is that we share the kids 50-50, she gets the house (net value around 250-300k), I keep my pension and retirement (very roughly the same value), I move into a house a few blocks away, and we continue to be friends and parents together, etc. We both move on romantically, and hopefully we don't date the same women.


We would like a VERY simple divorce. We don't want to go to court. We'd like to use the same lawyer. We've talked to at least two acquaintances who have done this - both parties waive getting separate counsel, the attorney draws up an agreement, submits it to the court, both parties walk away happy, end of story.


Questions:




  1. Is this possible to do, or were these acquaintances blowing smoke?




  2. We know a third party that had a very amicable divorce using the court mediator, and it went very well. However...I've heard of stories on this subreddit about the mediators becoming somewhat "activist" (for lack of a better word), however.




  3. Will we need to see a judge? (Again, the goal here is to make this as easy and stress free as possible, and neither of us want this.)
